Terms and Conditions

Terms and Conditions of Driver Training given by an Abracadabra Driving School Instructor (Instructor). Please feel free to ask for an explanation of any point that may be unclear to you. It is agreed that:

  1. The Instructor shall make their services as an Abracadabra Driving School Instructor available to the Pupil for the sole purpose of giving the Pupil driving tuition at the rate per lesson from time to time agreed.

  2. The Instructor shall have the right to substitute another Instructor for the purpose of giving all or any of the lessons if the Instructor is not available for any reason whatsoever.

  3. In the event that the Instructor is unable to substitute another Instructor for a specific appointment, or in the event of mechanical breakdown or other cause, the Instructor reserves the right to rearrange the lesson to a time convenient to both parties.

  4. The Instructor will carry motor insurance covering the Pupil whilst driving the tuition vehicle when accompanied by an Abracadabra Driving School Instructor or a Driving Standards Agency Examiner.

  5. The lesson fee shall be paid for in advance of each lesson. Payment by cash or bank transfer direct to your Instructor.

  6. Payment in respect of the current or next booking can be made to the Instructor.

  7. A driving lesson is defined as a session lasting approximately 60 minutes.

  8. If the Pupil fails to give the Instructor a minimum of 48 hours notice cancelling any lesson, the Pupil shall be liable for the lesson fee in respect of such lesson(s).

  9. All Prepaid Lessons, Ten Lesson Block Booking (Prepaid) are valid for up to 6 months from date of purchase. Thereafter no refund shall be given and any outstanding lessons will be forfeit.

  10. The Pupil cannot sell or transfer lessons which have been purchased by the Pupil to any other person.

  11. Abracadabra Driving School presents a great range of tuition with discounts to new and existing learner Pupils on learning to drive, Abracadabra Driving School reserves the rights to introduce (and to withdraw) discounts from time to time.

  12. The Pupil agrees that they are duly licenced to drive the tuition vehicle. You must notify your Instructor of any matters which affect your ability or entitlement to have driving tuition, for example, but not limited to, any lack, or loss, of a valid provisional driving licence or medical reasons such as epilepsy.

  13. Driving tests and bookings

  14. The Pupil will need to have passed their driving theory test before booking/ taking their practical test. Documents the Pupil must bring to their test: theory test pass certificate (or confirmation), and driving licence photocard. You must take your signed driving licence and a valid passport if you have an old-style paper licence.
    Your test will be cancelled and you’ll lose your fee if you don’t bring the right documents, the Instructor is not liable for any consequential loss. The practical driving test is designed to see if the Pupil: can drive safely in different road and traffic conditions, know the Highway Code and can show this through their driving ability. The Instructor reserves the right to refuse the use of a driving school vehicle for test if in the Instructor’s opinion the Pupil is not up to the standard required and considers that provision of a vehicle could cause a risk to public safety.
    Where a driving school car is used for test, the booking period will be based upon the Instructor’s normal diary schedule. Depending on the time of the test this will require a minimum two hour booking. While your Instructor will make every effort to ensure that the vehicle supplied for test will be fully road worthy and comply with all legal requirements at the start of the test, the Instructor cannot be held responsible for vehicle failure that occurs during the test and the Instructor is not liable for any consequential loss.
    The Instructor cannot be held responsible for test appointments cancelled by the Driver & Vehicle Standards Agency due to bad weather, sickness, staff shortages or any other reasons. Such cancellations are beyond the control of the Instructor and therefore the lesson fee and ‘use of car’ fee for the booked period will be charged.

  15. The Pupil acknowledges that, without prejudice to any such other obligations as Abracadabra Driving School may have to the Pupil, Abracadabra Driving School has and shall have no liability to the Pupil under this Agreement in respect of any injury, loss or damage arising from the use of the tuition vehicle or from the acts or omissions of the Instructor or any other Abracadabra Driving School Instructor substituted under Condition 2 above.

  16. Nothing in these Terms and Conditions will affect any statutory rights you may have as a consumer.

  17. These Terms and Conditions are governed by the laws of Scotland.
